guaranteed against defects as per Australian warranty rules. Except as
expressly stated herein, we make no representations or warranties, either
express or implied, of any kind with respect to products sold on this website.
Except as expressly
stated herein, we expressly disclaim all warranties, expressed or implied, of
any kind with respect to products sold on this website, including but not
limited to, merchantability and fitness for a particular purpose. By placing an
order, you agree that the sole and exclusive maximum liability to us arising
from any product sold on this website shall be the price of the product
ordered. In no event shall we be liable for special, indirect, consequential,
or punitive damages related to product sold.
Under no circumstances
whatsoever shall we be liable to the buyer for any loss or damage whatsoever
(including but not limited to loss of profit or the loss of any other form of
financial or non-financial benefit; loss of use of or damage to any property;
work stoppage; any special, indirect, incidental or consequential loss or
damage; costs; expenses; and other claims for compensation), arising out of or
in connection with the sale of any of our products (including any
misrepresentation, unless fraudulent); any breach of an implied or express
warranty, condition or other term; (or any breach of a common law duty), in an
amount exceeding the price of the product giving rise to the claim, except as
expressly agreed in writing by us.
All our products sold are
warranted to be free from manufacturer defects and Australian statutory
warranty applies. Please enquire at time of purchase if you wish to know more
about the warranty on a particular product. Batteries come under consumable
items and do not have the same warranty coverage, all
batteries have a 3 month warranty.
Sonic Art shall not be
held in any way liable to the buyer under this clause unless the conditions of
use and installation are complied with. This warranty will only be valid if the
following conditions are followed.
The product is installed
following the manufacturers recommendations.
The product is used under
normal operating conditions for which it was designed.
The product receives
proper maintenance if required.
The product has not been
subject to any modifications.
The product has not been
used in conjunction with or installed with any unauthorized equipment.
Sonic Art products are
guaranteed at the time of shipping to be in new condition unless otherwise stated in your order or on our website, for example, a trade-in item would not be classed as 'new condition'.
The customer takes
responsibility for the product being insured at the time of shipping if
required. Insurance is arranged at the request of, and cost to the customer.
Claims for uninsured items lost or broken in transit shall be dealt with by the
customer, Sonic Art is happy to help liaise with the
carrier but is not responsible for the order once it has shipped. If insurance
has been added to the order then Sonic Art will deal with the carrier to recoup
the funds, then either send out an identical replacement item or refund the
customer if a replacement is not available.
Shipping will be added to
the order once the order is placed, the customer will be informed of shipping
options and costs, once the customer decides on a shipping method they will
receive a final invoice to check and confirm, we then process payment via Card
if supplied, or the customer will process an EFT payment into the Sonic Art
bank account provided on the invoice.
Our Returns Policy
includes the rights you have under the Australian Consumer Law and provides you
with additional benefits in addition to those rights, because your satisfaction
is important to us.
Please choose carefully -
no refunds, credits or replacements are given if you change your mind, order
the wrong product or it doesn't meet your expectations, or you fail to verify
and accurately provide information when placing an order.
At our discretion, we may
agree to exchange incorrectly ordered products or offer store credit for them.
If an exchange or credit is approved a 10% restocking fee will apply. Any
freight and insurance costs to return the item to us are at your expense. This
includes the liability for any lost freight so we suggest sending via
registered post insured.
The customer must contact
Sonic Art to obtain a return authorization before sending any products back
otherwise we will accept no responsibility for the returned items. Goods must
be well packed, any damages occurring during return are not the responsibility
of Sonic Art, the customer must ensure he/she insures
the item/s being returned.
Goods being returned for
credit/refund must be in their original packaging and in as new unused
condition, it is at the discretion of Sonic Art to accept returns based on our
inspection of returned goods.
Prepaid orders for
backorder/special order products that we have to source from the factory cannot
be cancelled as we have to prepay the suppliers for these orders and they
cannot be returned. By ordering any backorder/special order product either via
phone, email or through the website shopping cart the customer agrees to these
terms. Estimated delivery times are based on the manufacturers
communication with Sonic Art and are not set, they are a guide only and there
can be delays beyond our control. The customer by placing an order with us, accepts that delivery times can vary and allows Sonic
Art up to 6 months to source a specialty product that has been prepaid.
